Get Well Soon Terms of Use

These Terms of Use (“Terms”) apply to Get Well Soon: AI Health Coach (“Get Well Soon” or the “App”), provided by GOBIAS LTD (“GOBIAS”, “we”, “us” or “our”). The App’s bundle ID is com.gobiasltd.getwellsoon. By downloading, accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

The App is intended for adults aged 18 and over. By using it, you confirm that you meet this requirement and can enter into a binding agreement under the law that applies to you.

2. What the App provides

The App lets you privately record meals, ingredients, symptoms, flare-ups and contextual factors. It may calculate cautious observations about possible associations between meals and symptoms. It also offers an optional AI Health Coach that provides general health information, emotional support and practical coaching.

Possible tracker associations are not diagnoses, proof of causation or confirmation that a food caused a symptom. Patterns can be incomplete, coincidental or influenced by factors the App does not know. Do not remove foods, change medication, delay care or make another important health decision solely because of an App observation or AI response.

3. No professional or emergency service

The App and AI Health Coach do not replace a doctor, dietitian, pharmacist, mental-health professional or other qualified provider. They do not establish a clinician-patient or therapist-client relationship. Information may be general, incomplete, unsuitable for your circumstances or out of date.

Do not use the App for emergencies or crisis support. If you think you may be experiencing a medical emergency, may harm yourself or someone else, or need urgent help, stop using the App and contact the emergency or crisis service appropriate to your current location. In the UK, call 999 or 112 for an emergency or NHS 111 for urgent medical advice when appropriate.

4. AI limitations

AI systems can misunderstand context and produce inaccurate, incomplete, inconsistent or inappropriate responses. The Coach does not know your complete history, cannot examine you and may not identify an urgent symptom, allergy, interaction, eating disorder or other risk. You must use your own judgment and verify important information with reliable sources and an appropriately qualified professional.

We do not guarantee that the App will identify food triggers, explain symptoms, achieve a particular outcome or provide uninterrupted, error-free or always-available responses.

5. Your account and information

Sign in with Apple is required for AI access. You are responsible for protecting your device and Apple account and for activity carried out through your access. You must provide information you have the right to use and should not submit another person’s health or personal information without appropriate authority.

Tracker records and conversations are handled as described in the Get Well Soon Privacy Policy. Coach Memory and sharing aggregated tracker insights with the AI are optional and off by default. You remain responsible for reviewing what you choose to store or share.

6. Free access, subscriptions and message allowances

Free users receive a limited number of AI Coach messages per day. Monthly and yearly automatically renewing subscriptions provide a higher daily allowance, subject to service availability and fair-use and safety limits. Current prices and the subscription period are shown in the App Store before purchase and may vary by country, currency, tax and Apple’s regional pricing. No free trial is currently offered unless the App Store purchase screen expressly states otherwise.

Payment is charged by Apple to your App Store account when you confirm the purchase. Your subscription automatically renews for the same period unless you cancel it at least 24 hours before the end of the current period. Apple may charge the renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple App Store account settings and restore eligible purchases using the App’s restore function. Deleting the App does not cancel a subscription.

We may apply clearly disclosed message limits, temporary capacity controls and reasonable safety or anti-abuse restrictions. A higher subscriber allowance is not a promise of unlimited messages or continuous service. Unless applicable law requires otherwise, billing, cancellation and refunds are administered by Apple under App Store rules.

7. Acceptable use

You must not:

• use the App unlawfully, fraudulently or in a way that harms another person;
• use the Coach as an emergency, diagnostic, prescribing or professional clinical service;
• submit content you do not have the right to use, including another person’s confidential or health information;
• attempt to bypass message limits, subscription controls, authentication, security or safety measures;
• probe, overload, disrupt or gain unauthorised access to the App, backend or connected systems;
• use automated means to scrape, extract or send excessive requests to the service;
• reverse engineer or copy the App except to the limited extent applicable law expressly permits; or
• use App output to develop a competing model or service, or commercially redistribute it, without our written permission.

8. Intellectual property

The App, its software, branding, interface, supplied content and underlying materials are owned by or licensed to GOBIAS LTD and are protected by intellectual-property law. We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the App for your own non-commercial purposes in accordance with these Terms.

You retain rights in information you enter. You give us only the limited permission needed to process information you choose to send to provide, secure and operate the requested features, as explained in the Privacy Policy. AI output may not be unique, and similar output may be provided to other users. We do not promise that AI output is protected by intellectual-property rights.

9. Third-party services

The App relies on services provided by Apple, RevenueCat, Hetzner and Google Gemini. Their availability and some processing are outside our direct control and may be governed by their own terms. We are not responsible for an independent third party’s service except to the extent required by law.

10. Changes and availability

We may update, suspend, limit or discontinue part of the App where reasonably necessary for maintenance, security, legal compliance, provider changes, capacity, product development or commercial reasons. We will aim to give reasonable notice of material changes where practical. Updates or a supported version of iOS may be required. We do not guarantee that locally stored information can always be recovered, so you should not use the App as the sole record of information you need to retain.

11. Suspension and termination

You may stop using the App at any time. We may suspend or terminate AI access if you materially or repeatedly breach these Terms, create a security or safety risk, fail to pay a charge due, or if suspension is reasonably required by law or a service provider. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue. Ending access does not automatically cancel an Apple subscription; you must cancel it through Apple.

12. Consumer rights, disclaimers and liability

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded, including mandatory consumer rights, or liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to those protections, the App is provided on an “as available” basis. To the fullest extent permitted by law, GOBIAS LTD is not responsible for loss that was not reasonably foreseeable when you agreed to these Terms, loss caused by your misuse of the App or reliance on it as professional advice, or business loss because the App is supplied for personal use. We are not responsible for decisions to delay or avoid professional care or to change medical, medication or dietary arrangements based solely on App content.

If defective digital content supplied by us damages a device or other digital content you own, and the damage was caused by our failure to use reasonable care and skill, you may have a right to repair or compensation under applicable consumer law. Nothing in these Terms removes that right.

13. Apple terms

These Terms are between you and GOBIAS LTD, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. Your use must also comply with the Apple Media Services Terms and Conditions and any usage rules that apply to the App. To the extent Apple’s standard Licensed Application End User License Agreement applies and conflicts with these Terms, the terms that give you the greater mandatory protection will apply. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. If you are a consumer, you retain mandatory protections and any right to bring proceedings available under the laws and courts of the part of the UK or other country where you live. Please contact us first so we can try to resolve a concern informally.

15. Changes to these Terms

We may update these Terms for legal, security, operational or feature changes. We will publish the revised Terms at this URL with an updated date and provide additional notice where required. If you continue to use the App after revised Terms take effect, the revised Terms will apply; this does not affect rights already accrued or changes requiring your express agreement.
